Florida law provides two primary remedies for clearing your criminal record: expungement and sealing.
Expungement
In Florida, expungement (technically called "expunction") physically destroys your criminal record, with only a single copy maintained by the Florida Department of Law Enforcement (FDLE). Expungement is possible when:
- No charges were filed after your arrest
- All charges from your arrest were dismissed before trial
- You received a verdict of not guilty or acquittal at trial
- You previously had your record sealed for at least 10 years
Sealing
Sealing your record keeps it confidential and restricts public access. Your record remains accessible only to certain government agencies and in specific circumstances. Sealing is available when:
- You received a withhold of adjudication (not a conviction)
- You completed a diversion program
- You were never convicted of the charge
Important Florida Limitation
Florida law currently allows only one arrest record to be sealed or expunged per lifetime. If you have multiple arrest records, it's crucial to carefully consider which one to clear.
The Florida Process
The Florida expungement and sealing process typically involves:
- Obtaining a Certificate of Eligibility from the FDLE
