Expungement

Sealing

Sealing your record keeps it confidential and restricts public access. Your record remains accessible only to certain government agencies and in specific circumstances. Sealing is available when:

• You received a withhold of adjudication (not a conviction)
• You completed a diversion program
• You were never convicted of the charge

The Florida Process

The Florida expungement and sealing process typically involves:

1. Obtaining a Certificate of Eligibility from the FDLE
2. Preparing and filing a petition with the court where your case was handled
3. Attending a hearing (if required by the court)
4. Receiving a court order for sealing or expungement
5. Having the FDLE process the order to complete the sealing or expungement

This process typically takes 5-7 months from start to finish but can take longer depending on the court's caseload.
